Letter of Employment Now Compulsory
Each domestic worker is now required to have a Letter of Employment on “Form A.”
This letter will specifically state the job description of the worker, salary, and duties — promoting clarity between the employer and employee.
Safe and Respectful Workplace
Employers are now obligated by law to provide a clean, safe, and respectful working environment.
They must also make available:
- Clean water for drinking
- appropriate place to sleep
- Sufficient food
For pregnant working women, lighter tasks and precautions are an obligation. There must also be a conducive environment throughout maternity for employers to provide.
Controlled Overtime and Just Compensation
Employers may only delegate additional work with the worker’s written permission.
• Maximum overtime: 8 hours a week
• Remuneration: Double pay for overtime work
This is a significant departure from the past ad-hoc ways, ensuring fair voice and rightful payment for workers.
Annual Leave and Record Keeping
Employers are required to keep records of annual leave in “Form B.”
Female domestic workers, for maternity leave, are required to give notice via “Form D.”
Domestic staff residing on-site must also be given:
• A minimum 42-square-foot room
• Appropriate light, ventilation, and privacy
Health and Safety Requirements
Employers are required to get a health certificate for each employee via “Form E.”
In the case of a sad accident or death, reports are to be submitted through “Form F” and “Form G.”
Dispute Resolution System
Should any problem occur — like not bringing back one’s personal things — typically, domestic workers can now seek the Dispute Resolution Committee set up at the Union Council (UC) level.
It is tasked with settling disagreements justly and in a timely manner.
